Terms of Use
Please read these terms before using KinderHive. By creating an account or using the service, you agree to them.
1.About these terms
These terms are an agreement between you and Purple Hive Group Limited (“Purple Hive”, “we”, “us”) for using KinderHive, our website, web app and installable app.
Nurseries that subscribe to KinderHive also agree to our Subscription Terms (plans, the free trial, payment, auto-renewal and cancelling) and our Data Processing Agreement (how we handle the records a nursery keeps). If they say something different from these terms, they apply to the nursery. A nursery may also have a separate written agreement with us, which then applies instead.
2.Who can use KinderHive
- KinderHive is for nursery managers and owners, the staff they invite, and the parents and carers they invite. You must be 18 or over to have an account.
- Your account is personal to you. Keep your password and any PIN private, and tell your nursery or us straight away if you think someone else has used them.
- Give accurate information and keep it up to date.
- Nurseries are responsible for the classroom tablets and kiosks they pair, including who can physically use them and keeping the manager exit PIN private.
3.Nursery responsibilities
If you use KinderHive on behalf of a nursery, the nursery:
- is the data controller for the records it keeps, and is responsible for having a lawful basis for them, including any consents (for example to share photos);
- is responsible for the accuracy of the information it records and for who it invites;
- remains responsible for meeting its legal and regulatory duties, including staff-to-child ratios, the EYFS, safeguarding and reporting to the relevant authorities. KinderHive’s ratio checks, reports and reminders help with this, but they do not replace a nursery’s own judgement and checks;
- must make sure its staff use KinderHive in line with these terms.
4.Parents and carers
- The information you see about your child is recorded by your nursery. If something looks wrong, ask the nursery to correct it.
- Photos and updates are shared with you for your own family’s use. Please don’t post images that show other children publicly without their parents’ permission.
- Only add authorised collectors you trust, and keep their collection PINs private.
- Fees and payments are agreed between you and your nursery. Purple Hive is not a party to that agreement. If your nursery takes fees by card or Direct Debit, the payments are taken by Stripe for the nursery; Direct Debits have the protection of the Direct Debit Guarantee.
5.Acceptable use
You must not:
- try to access records, accounts or nurseries you are not authorised to see;
- upload anything unlawful, harmful or abusive, or use messaging to harass anyone;
- interfere with the security or running of the service, or introduce malware;
- copy, scrape, reverse engineer or resell the service, except where the law allows it;
- use KinderHive in a way that breaks the law or anyone else’s rights.
If you find a security problem, please report it to us privately rather than testing it further.
6.Your content and our software
Nurseries and users keep ownership of the information and photos they add. You give us permission to store, process and display that content only as needed to provide KinderHive, as described in our Privacy Policy.
We own KinderHive, its software, design and brand. These terms give you the right to use the service; they don’t transfer any ownership to you.
7.Availability and changes
We work to keep KinderHive available and reliable, but we can’t promise it will always be uninterrupted or error-free. We may need to pause it briefly for maintenance or urgent security work, and we will try to give notice where we can.
We improve KinderHive over time and may change or remove features. If a change significantly affects how a nursery uses the service, we will tell them in advance.
8.Plans, the free trial and payment
Nurseries pay for KinderHive on a Bronze, Silver or Gold plan. The full rules are in our Subscription Terms; in short:
- Each nursery can have one 30-day free trial of the Gold plan, once we have approved the nursery. A Direct Debit is needed to start it, and nothing is collected until it ends. Before it ends the nursery can keep Gold or switch to Silver or Bronze.
- Plans renew automatically each month (or each year, for yearly plans) until a manager switches off auto-renew or cancels. We remind managers before a trial ends.
- If a payment fails, or a trial or plan ends, the nursery has 7 days’ grace. After that the manager and staff pages pause until a plan is chosen. Records are not deleted.
- Parents and carers don’t pay KinderHive anything. Nursery fees are between families and their nursery.
9.Suspending or closing accounts
We may suspend or close an account, or a nursery’s access, if these terms are seriously broken, if we need to protect children, users or the service, or if the law requires it. Where it is safe and lawful, we will explain why.
You can stop using KinderHive at any time. A nursery that leaves can ask for its records; we will return or delete them as described in our Privacy Policy and any agreement with the nursery.
10.Our responsibility to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. If you use KinderHive as a consumer, your statutory rights are not affected.
Otherwise, we are not responsible for losses that were not reasonably foreseeable, for business losses (such as lost profit or revenue), or for losses caused by events outside our reasonable control. A nursery’s agreement with us may set out further limits.
11.Changes to these terms and governing law
We may update these terms. The date at the top shows the latest version, and we will tell users about significant changes. If you keep using KinderHive after a change takes effect, the new terms apply.
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in the courts where you live.
